Terms of Sale
The buyer-facing rules for ClearCycle auctions, vendor marketplace sales and Trade Deal Desk transactions.

1. Scope
These Terms of Sale apply when you use ClearCycle Auctions to browse lots, register as a buyer, place bids, win auction lots, purchase stock, use the Trade Deal Desk, or buy from ClearCycle or approved vendors through the platform.
Separate auction event terms, lot descriptions, vendor-provided terms, payment instructions, collection/delivery instructions, Trade Deal Desk offer terms or written agreements may also apply. If there is a conflict, the more specific event, lot or written terms will usually take priority for that transaction.
2. ClearCycle, vendors and marketplace sales
Some lots are sold by ClearCycle. Some lots may be sold by approved third-party vendors using ClearCycle as a marketplace, auction platform, broker or sale administrator. Event pages identify important event information, including payment methods, collection/delivery instructions and event terms.
Buyers should check whether a lot is a ClearCycle lot or vendor lot before bidding. Vendor events may have their own collection locations, payment instructions, fulfilment arrangements and buyer-facing sale terms.
3. Buyer registration and account use
- You must provide accurate account and contact information.
- You are responsible for all activity on your account.
- ClearCycle may refuse, suspend or close accounts where there is suspected fraud, abuse, non-payment, chargeback misuse or breach of these terms.
- ClearCycle may decline a registration, withdraw bids or request further verification where payment card, address, account or identity checks do not match.
- Trade buyers must ensure they have authority to bid or submit offers on behalf of their business.
4. Bidding and auction completion
Bids are commitments to buy. Do not bid unless you are willing and able to pay for and collect the lot according to the event terms. When an auction closes and you are the winning bidder, an order/invoice may be created for the winning lot, buyer premium, VAT where applicable, and any other stated charges.
Auction events may use staggered end times, reserves and bidding extensions. The final end time of an event may move if bidding activity extends individual lots. ClearCycle may regulate bidding, correct mistakes, withdraw lots, combine or divide lots, rearrange the order of sale, cancel a sale where reasonably necessary, or permit reserve-related bidding where lawful and disclosed as required.
5. Buyer premium, VAT and charges
Unless an event states otherwise, ClearCycle charges a fixed 20% buyer premium on auction lots. VAT is applied where required. Buyer premium is retained by ClearCycle, including for approved vendor sales, and forms part of how the platform is paid.
Other charges such as delivery, handling, storage, relotting, administration or payment-related charges may apply if stated in the event, lot, invoice or agreed terms.
6. Payment
Buyers must pay by the stated deadline and using the stated payment method. For ClearCycle auction events, full payment is normally required by the deadline shown in the event terms or invoice. ClearCycle may send payment reminders and may restrict further bidding while invoices remain unpaid.
If a buyer does not pay within the required period, ClearCycle may cancel the sale, mark the lot as unpaid/no-sale, restrict the buyer account, pass overdue accounts for recovery where appropriate, and move the lot into relotting or another recovery process.
7. Condition, grading and descriptions
Lots may be returns, used goods, clearance stock, liquidation stock, damaged items, BER goods, salvage, spares, incomplete items or untested stock. Descriptions, photographs, titles, grades and notes are provided to help buyers assess lots but may not list every mark, fault or missing part.
Buyers should inspect all available information before bidding, attend viewing where available, and ask questions before the auction closes. Where a lot is described as BER, salvage, spares, untested, damaged, customer return or sold as seen, buyers accept a higher level of risk.
Terms such as “tested working”, “powers on” or similar describe only the level of basic checking stated in the event or lot information. They do not create a full warranty, full function test or guarantee unless the lot expressly says so.
8. Collection and delivery
Collection and delivery arrangements are stated in the event, lot or vendor terms. Buyers are responsible for collecting within the required timescale unless delivery is offered and paid for. Goods will not be released until paid for in full. Risk may pass to the buyer on collection, delivery handover or another point stated in the event terms.
Buyers must bring suitable vehicles, labour, packaging, equipment and identification where needed. ClearCycle or the vendor may refuse unsafe collections, unscheduled arrivals or collections that do not meet site rules.
9. Vendor sales and vendor terms
Approved vendors must provide accurate lot information and buyer-facing event terms. Vendor terms may cover payment methods, collection/delivery, sale notes and local requirements. ClearCycle may moderate or override vendor content where needed to protect buyers, comply with law or operate the platform.
10. Safety, restricted resale and site conduct
Buyers are responsible for checking the safety and suitability of mechanical, gas, electrical, network-connected or previously owned goods before use, resale or installation. Where needed, buyers should obtain competent professional testing or advice before using any lot.
Where a lot is marked “not for online resale” or similar, the buyer must follow that restriction. ClearCycle may share relevant buyer and purchase details with the vendor where needed to enforce a stated resale restriction.
Visitors attend ClearCycle or vendor premises at their own risk and must comply with site rules, including any requirements for protective footwear, high-visibility clothing, safe loading and staff instructions. Buyers must not contact ClearCycle clients or vendors directly outside the platform without prior written consent where that restriction is stated or reasonably required to protect a managed sale relationship.
11. Refunds, cancellations and disputes
Refunds and cancellations are handled under the Refund and Returns Policy, event terms, lot details and applicable law. ClearCycle may request photos, evidence, return of goods or vendor input before deciding an issue.
Buyer accounts may be restricted where there is repeated non-payment, abusive conduct, false claims, chargeback misuse, unsafe collection behaviour or breach of these terms.
12. Trade Deal Desk
The Trade Deal Desk is a broker-assisted private deal service. Sellers may submit stock privately, buyers may submit offers or mandates, and ClearCycle may circulate opportunities to selected buyers. Trade Deal Desk submissions do not guarantee a sale, offer, buyer introduction or accepted price.
Private deals may be subject to separate written offer terms, commission, inspection rights, payment terms, confidentiality, collection/delivery requirements and commercial agreement.
13. Vendor settlement
For approved vendor auction sales, ClearCycle normally settles vendor proceeds after the buyer has paid, the post-sale process has completed, the lot has not been cancelled/refunded/disputed, and any agreed deductions have been applied. Buyer premium is retained by ClearCycle.
14. Website availability and errors
We try to keep the website accurate and available, but errors, downtime, stock mistakes, pricing issues or technical issues may occur. ClearCycle may correct errors, withdraw lots, cancel transactions, relist lots or amend event information where reasonably necessary.
15. Liability and legal rights
Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory rights that cannot be excluded. Subject to that, ClearCycle is not responsible for indirect loss, loss of profit, loss of opportunity, business interruption or losses caused by buyer misuse, vendor misinformation, unavailable stock, third-party services or events outside our reasonable control.
16. Changes to these terms
We may update these terms as the marketplace, vendor services, Trade Deal Desk or legal requirements develop. The version on this page applies from the date shown above unless a separate written agreement states otherwise.
17. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction unless mandatory consumer law requires otherwise.
